Protecting your trademark in Haiti

Trademark registration in Haiti is filed with the Industrial Property Service. The procedure includes formal examination, publication, an opposition window, and finally issuance of the certificate. A trademark is valid for ten years, renewable. We handle the full procedure — for foreign groups extending their international portfolio to Haiti as well as for Haitian brands seeking protection abroad.

How long does trademark registration take in Haiti?+

From filing to certificate issuance, generally twelve to eighteen months absent opposition. Protection backdates to the filing date, providing coverage from the outset.

Do I need to register my trademark in every country?+

Trademark protection is territorial: a Haitian registration only protects in Haiti. For regional or global coverage, we coordinate filings in each target country, or via the WIPO international system where available.

What can I do if someone copies my trademark or product?+

We first send a formal cease-and-desist; if it goes unanswered, we bring an infringement action before the Haitian courts, possibly preceded by emergency proceedings to order the immediate stop of the infringement.

Can software or a website be protected?+

Yes, through copyright, which protects the expression of code and content. For innovative functional elements, patents may sometimes be considered. We advise on the strategy best suited to your activity.
